AfterlifeLetters ("Service") is a platform operated by HIDA SISTEMAS LTDA that allows users to write letters and schedule their delivery to designated recipients in the future. The Service includes letter storage, delivery scheduling (by fixed date or days after confirmation), trusted contact notifications, and periodic check-in reminders to ensure letters are not delivered prematurely. By accessing or using the Service, you agree to these Terms of Service.
2. Acceptance of Terms
By creating an account, subscribing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
3. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements. The Service is not intended for minors.
4. Account and Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must verify your email address before certain features become available. We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a security risk.
5. Subscription and Payment
The Service operates on a subscription model. Payment processing is handled by Stripe. By subscribing, you authorize us to charge your payment method according to your chosen plan. Plans renew automatically unless cancelled. You may cancel your subscription at any time; cancellation will take effect at the end of the current billing period. Refunds are handled in accordance with our refund policy and applicable law. We may change pricing with advance notice.
6. User Content
You retain ownership of all content you create, including letters and attachments. By using the Service, you grant us a limited, non-exclusive license to store, process, and deliver your content to your designated recipients in accordance with your instructions. We do not use your content for marketing or sell it to third parties. You are solely responsible for the content you create and ensure it does not violate any laws or infringe on any third-party rights.
7. Trusted Contacts
You may designate trusted contacts who will be notified if we are unable to confirm your status after a period of inactivity. You are responsible for obtaining consent from these individuals before adding them. Trusted contacts may be asked to confirm your status to prevent premature delivery of your letters. We process trusted contact information only to fulfill this function.
8. Check-in and Delivery Triggers
To prevent letters from being delivered prematurely, we use a check-in system. You agree to respond to check-in reminders within the timeframes specified. If you do not check in and we cannot verify your status through trusted contacts, we may escalate the process according to our delivery policy. Failure to check in may result in letters being held until verification is obtained.
9. Acceptable Use
You agree not to use the Service for any unlawful, harmful, abusive, or fraudulent purpose. Prohibited uses include: transmitting illegal content, harassing others, impersonating others, distributing malware, or circumventing security measures. We reserve the right to remove content and terminate accounts that violate these terms.
10. Limitation of Liability
To the maximum extent permitted by applicable law, the Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. We are not responsible for delays or failures due to circumstances beyond our reasonable control.
11. Termination
You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms. Upon termination, your access to the Service will cease. Letters already scheduled for delivery may be handled according to our data retention policy. We recommend exporting or making arrangements for your content before terminating.
12. Changes to Terms
We may modify these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.
